Kto może ogłosić upadłość konsumencką w Polsce w 2025 roku?

Upadłość konsumencką może ogłosić każda osoba fizyczna, która:

  • nie prowadzi działalności gospodarczej (lub już ją zakończyła),
  • jest niewypłacalna, czyli nie jest w stanie spłacać zobowiązań przez co najmniej 3 miesiące.

Nie ma znaczenia, z jakiego powodu powstały długi – nawet jeśli były wynikiem lekkomyślności czy błędnych decyzji finansowych.


Jak ogłosić upadłość konsumencką krok po kroku?

1. Zbierz dokumenty

Przygotuj wszystkie dane finansowe: umowy kredytowe, wezwania do zapłaty, nakazy sądowe, umowy o pracę i inne dochody.

2. Złóż wniosek do sądu

Wniosek składa się przez portal KRZ (Krajowy Rejestr Zadłużonych) lub osobiście w sądzie. Opłata wynosi 30 zł.

3. Czekaj na decyzję

Sąd bada sytuację majątkową i podejmuje decyzję o ogłoszeniu upadłości. Może to potrwać od kilku tygodni do kilku miesięcy.

4. Postępowanie upadłościowe

Sąd może wyznaczyć syndyka, który sprzeda Twój majątek (jeśli taki posiadasz), a reszta długów może zostać umorzona lub rozłożona na plan spłaty.


Ile trwa postępowanie i jakie są jego koszty?

  • Czas trwania: od kilku miesięcy do 3 lat, w zależności od skomplikowania sprawy i planu spłaty.
  • Koszty: Opłata sądowa to 30 zł. Dodatkowo, jeśli zostanie powołany syndyk, mogą pojawić się dodatkowe koszty (pokrywane zwykle z majątku dłużnika).

Bessie Bian has a master's degree in economics. She graduated from the Polish Language School for Foreigners at the University of Łódź and studies Master's degree at the Faculty of Economics and Sociology of the University of Łódź, as well as postgraduate studies in translation in the field of Polish-Chinese languages ​​at the Center for Migration Studies of the University of Łódź.

She has experience in Polish-Chinese translation in court proceedings. She served as a full-time translator in a highway construction project implemented by a Chinese consortium. Attorney Katarzyna Kolasa has been a member of the District Chamber of Legal Advisors in Kraków since 2019. She is a graduate of the Faculty of Law and Administration at Jagiellonian University, where she studied law. She is also a restructuring advisor.

Since 2007, she has been involved in public procurement and public-private partnerships.
